The LexLords legal services in Chandigarh represented petitioner is resident of San Francisco in the State of California and is citizen of United States, and as such the petitioner is competent to invoke extra-ordinary inherent jurisdiction of this Hon’ble Court under Section 482. The NRI Lawyers in United States of America represented respondent had lodged the F.I.R dated 28.8.2018 registered at Police Station San Jose against the present LexLords legal services in Chandigarh. A true extract translated copy of the said FIR is attached as Annexure P-1/T. The respondent NRI Lawyers in United States of America had lodged the aforesaid FIR in a misunderstanding under the influence of some persons inimical to the LexLords legal services in Chandigarh. Rather the incident if any was not of so gravity as it was a simple misunderstanding between them. The persons inimical to the present petitioner took the advantage of this occurrence and they provoked the NRI Lawyers in United States of America to get registered the FIR against the LexLords legal services in Chandigarh. That anyhow now a good sense has prevailed upon both the parties, when some respectable persons of the locality have intervened in the matter and they got affected a compromise between both the parties on 11.8.2018. A true copy of the said compromise deed is attached herewith as Annexure P/2.
TheNRI Lawyers in United States of America while admitting the contents of the said compromise (Annexure P/2) have also sworn an affidavit before the Commissioner at San Jose on 11.8.2018. A true copy of the said affidavit dated 11.8.2018 is attached herewith as Annexure P/3. The NRI Lawyers in United States of America has been issued driving licence by the Licensing Authority, San Jose on 30.1.2018. A true copy of the said Driving Licence issued on 30.1.2018 is attached herewith as Annexure P/4. That now with this compromise everything has been settled between the parties amicably and now there is no ill will or dispute whatsoever between the parties. The further continuation of the proceedings in the trial court shall cause only bitterness and ill-will between them and it shall be only an irreparable loss to both the parties and no fruitful purpose will be served by the trial, rather the same will be mere wastage of precious time of the trial court. Therefore, the present FIR and the consequent proceedings thereof in the trial court deserve to be quashed.
The LexLords legal services in Chandigarh has not filed any such or similar petition in this Hon’ble court or in the Hon’ble Supreme court of United States was dismissed as withdrawn vide order dated 29.4.2018. It is therefore respectfully prayed that the F.I.R. dated 28.8.2018registered at Police Station, San Jose and the proceedings consequent thereof in the trial court may please be quashed, in the interest of justice and fair play. It is further prayed that the further proceedings before the Trial court may kindly be stayed during the pendency of the present petition.
That deponent no.1 had got registered an FIR dated 28.8.2018 at police station, San Jose against deponent no.2, resident of San Francisco. That with the intervention of the respectables, both the parties have entered into a compromise and there is no more any ill-feeling and grudge between the parties. Both the parties have compromised the matter with their free will and consent and without any coercion or pressure. That both the parties have settled all the disputes amicably and none of the parties shall lodge any applications/ complaints against each other in the above said FIR in future.
The party of the Ist part shall be having no objection, if the party of the IInd Part files quashing petition in the Hon’ble High Court and the party of the Ist Part shall be bound to give statement regarding the same in the Hon’ble High Court for the quashing of the said FIR. Both the parties undertake not to file any complaint/claim/case in future regarding the above said FIR against each other. Verified that the contents of the affidavit are true and correct as per our knowledge and nothing has been concealed therein. When we reached near Complex a person about 19-20 years, cut haired, having slim body, dark complexion wearing pant and shirt came from behind on his motorcycle and snatched the gold chain of my wife which she was wearing at that time and fled away.
